Check return case: Former BJP MP from Surendranagar Devji Fatehpura jailed for 2 years and fined Rs 2.97 crore

  • He handed over a check for the return of Rs 1.48 crore taken from the land, which was returned

Former Surendranagar BJP MP Devji Fatehpura has been sentenced by a Kalol court to two years simple imprisonment and a fine of Rs 2 crore 97 lakh 10 thousand in a check return case of Rs 1.48 crore in 2016. On October 13, 2016, Prabhat Singh Thakore of Ahmedabad had lodged a complaint against Devji Fatpura in the Kalol Court regarding the check return.

Prabhat Singh Thakor and Devji Fatehpura were good friends and acquaintances of each other. Devji Fatehpura had decided to sell agricultural land in Rajkot to Prabhat Singh and Devaji Fatehpura had received Rs. The banakhat was made on April 25, 2014. 

However, as the land could not be documented later, Devji Fatehpura handed over a check of Rs 1 crore 48 lakh 50 thousand from SBI, Gandhinagar branch to Prabhat Singh to return the amount paid by Banapet.

If he does not pay the fine, he will be sentenced to three more months. So Prabhat Singh sent a notice to Devji Fatehpura regarding the return of the check. However, Devji Fatehpura did not return the check to Prabhat Singh during the notice period. 

Prabhat Singh had lodged a complaint against Devji Fatehpura in Kalol court for non-payment of the check. At the end of the evidence, testimony of the plaintiff and witnesses and the argument of both the parties,

 the Kalol court sentenced Devji Fatehpura to 2 years simple imprisonment and imposed a fine of Rs 2 crore 97 lakh and Rs 10,000. Prosecutor Prabhat Singh has been asked to pay the fine and if not paid, a further sentence of three months has been ordered by the Kalol court.
